Online Terms & Conditions of www.HampshireFurniture.co.uk.

By using or accessing our website and/or placing any order(s), you agree to be legally bound by these terms and conditions.

If you do not wish to be bound by these terms and conditions then you may not use or access our website or place orders.

These terms relate to sales over the Internet and by telephone for the web site www.HampshireFurniture.co.uk. Separate terms and conditions may apply to purchases made by any other methods with our company.

The contract made by you online with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions.

We advise that you should not proceed with your purchase until you have read and agreed to these terms and conditions.

1 General Terms and Conditions

1.1 Contractual Capacity

In order to be eligible to enter into a contract with us to purchase goods, you must:

- Provide us with all the information we need to be able to proceed with your order including, but not limited to; payment method, delivery address, delivery telephone number, and contact email address.

- Inform us of any circumstances that may interfere with our ability to fulfil your order, for example, delivery access issues.

- Be over the age of 18.
 

1.2 Cancellation by Us

We reserve the right not to accept any order request if:

- Any of the terms in section 1 are contravened.

- We have insufficient stock to deliver the goods you have ordered

- We are unable to deliver to the delivery address on the order because it is not within our network coverage

- One or more of the goods ordered was incorrectly described or priced on the website

- The payment transaction is not authorised

1.3 If we do cancel your contract we will notify you by e-mail and will refund to you any sum paid by you to us in respect of the contract as soon as possible, and in any event within 30 days of the cancellation of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

1.4 Unforeseen Circumstances

While every effort is made to meet our customers' demands, cancellations or variations may be necessary as a result of an Act of God, war, strike, lockout, labour dispute, fire, flood, drought, or other causes beyond our reasonable control.

1.5 Complaints and Remarks

If you have a complaint or a particular remark to make please do not hesitate to contact us immediately by email, telephone or fax, the details of which are contained under the “Contact Us” page, or the contact information section below.
Any complaint will be dealt with fairly, effectively and confidentially. You will receive a formal written response from us within 10 days. Your statutory rights as a consumer are unaffected.

1.6 Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected.

2 Product Specifications

2.1 All our furniture is made from quality natural wood and accordingly appearances may vary. So you can be certain you are cleaning and caring for your product in the correct way we would advise you to read the care instructions that are included with your furniture as soon as you accept delivery and to contact us if you require further information before you carry out any furniture care.

2.2 Some woods will mellow with age and exposure to sunlight. When you are purchasing our furniture you are buying handmade furniture where varying degrees of distressing is often applied. This is very much intended and makes each piece totally individual as desired by the craftsmen. We sell only genuine rustic designs with varying degrees of distressing from piece to piece; this may involve wood splits, wood filling, knots, purpose distress/scratch marks, antiquing etc etc. Certain degrees of filler will be used on oak furniture this is common and very much part of the manufacturing process. Please note that our Indian items are usually of a very rustic nature and a heavy distressing is usually applied, this may appear as a dulling or rubbing effect to the waxed finish, knotty and grainy woods are used, this is as intended by the supplier.

2.3 The majority of our products are sold fully assembled, however on occasion certain pieces will need minimal assembly, this has been deemed fit to protect the item in carriage and/or to facilitate transport of the furniture into your home. All items needing assembly will have instructions included.

2.4 We endeavour to display on the website the colours of our products that appear as accurately as possible. However we cannot guarantee the complete accuracy of the pictures or photographs that are shown. Many conditions such as monitor settings and camera lighting can affect the colouring of items in a picture. Similarly natural wood colour can vary from tree to tree and an exact colour match for solid wood products cannot be guaranteed.

2.5 Made to order items are made to the specification listed on the product page. No customisations are possible.

2.6 Furniture Designs and Characteristics

By placing an order with us, you are acknowledging the following:

- That on occasion, we may alter the designs or sizes of pieces slightly. We cannot accept these as faults but you can return the item with all original carriage charges and collections costs being at the buyer’s expense. If the item is for a specific purpose please be sure to email ahead before ordering to check that there are no specific changes that could affect its material usage.

- The majority of our furniture is hand crafted, and as a consequence, all sizes are offered as a guide only. We reserve the right to change specifications without prior notice.

- It is virtually impossible to accurately portray the actual colour of natural wood products or upholstery fabric in a web picture, due to differing screen resolutions, and natural variations from batch to batch and piece to piece.

With regards to our wood furniture, we endeavour to give the best portrayal of colour, but we cannot accept colour or shade differences as evidence of defects. As a general rule, dark items look lighter in reality, and light items look darker in reality. A close match is more likely if two or more items are purchased at the same time because they more likely to come from the same batch, however this cannot be relied apon or guarenteed.

- If you wish to return an item because of a shade difference or any other reason, we are willing to offer a refund as long as we are informed within 14 days. However, original carriage charges and collection costs will be at the Customer’s expense, and the returned item must be resellable as ‘brand new’ as per the terms stated in the 'Returns' section.

2.7 Measurements

We will not accept any liability for any extra costs incurred by you as a result of incorrect or incomplete measurements or information supplied by you, or minor alterations made by the supplier. Please email ahead of placing your order if a small change in size may deem the item unusable when it arrives.
All dimensions specified by us are approximate.

3 Prices and Payment

3.1 All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.

3.2 Pricing Policy

It is the company’s policy to comply with the Code of Practice for traders on price indications issued by the D.T.I. Consumer and Competition Policy Directorate.

3.3 Goods are delivered on weekdays and weekends directly to your home address, to a downstairs room of your choice. If you live within the UK mainland, the delivery will be free of charge for all orders. We use different methods of carriage which we will determine on purchase. On larger or multiple items you will receive a call from our carriers to book a convenient delivery date that suits the carriers' pre-allocated delivery route. For smaller items, a parcel carrier may be used.

3.4 The prices displayed on the website are for online purchases and promotions only and are not transferable to sales through any other means.

3.5 The prices displayed on the website in relation to any online promotion are valid strictly until midnight on the day on which the promotion expires, as determined by us.

3.6 We will not be bound to honour any online listed prices, where we have indicated to you subsequently that the prices displayed have been displayed in error. In these cases a refund will be offered.

4 Payment

4.1 You must pay by credit, charge, bank transfer or debit card at the time of order. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website will be correct; that the credit charge or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.

4.2 Payment will be taken in full at the time of the order.

4.3 The contract shall not have been concluded until we have completed all of the following steps: we have received your valid credit card charge or debit card payment details or you have paid by bank transfer, we have accepted your online order and sent you confirmation of receipt of your order by return e-mail to the address you have given us during the registration procedure and upon completion of the above steps we have dispatched your order to you.

4.4 We are entitled to refuse any order placed by you.

4.5 All credit and debit card payments are made through a secure ePayment system. No financial information is kept or stored with our company. If you purchase multiple products on different days you will have to go through the payment process again.

5 Delivery (Free Delivery*)

5.1 We are only able to deliver online orders to you if you have a permanent address on the UK mainland and UK Isles.

5.2 We will endeavour to fulfil your order by the date set out in the email by which we confirmed your order. Where this email did not contain such a date we shall endeavour to fulfil your order within the time-scales advertised on the individual products on your order. All purchases must make allowance of 21 days from date of dispatch for our carriers to fulfil the final delivery to your home.

5.3 Orders totalling less than 30kg may be dispatched by post or courier.

5.4 For all orders - any changes made to the content of your order will have an impact on your delivery date. We may therefore be unable to deliver your goods on your confirmed delivery date should changes occur and if so, a new delivery date will be given.

5.5 You are responsible for providing a safe means of access from the public highway to the place of delivery. If our delivery staff considers that access is unsafe then we will not deliver the goods until safe access is provided.

5.6 If you are unable, for whatever reason to take delivery of your goods on the confirmed delivery date arranged by our carrier or we are unable to deliver the goods due to there being no safe means of access to the place of delivery or you are not available at the time pre-arranged on the day for delivery we shall be entitled to either cancel your order and refund your payments less an aborted delivery fee of £40 levied by our carriers or keep your order live but charge you the £40 fee levied by our carriers for the missed delivery.

5.7 If our carriers accidentally damage goods in the course of delivery our liability for that damage is limited to the repair, replacement or refund of the goods or the value thereof.

5.8 Time of delivery is not of the essence in these terms and conditions. We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of www.HampshireFurniture.co.uk or any reasonable rescheduling of delivery.

5.9 For the details of our free delivery offer please look at the Free delivery page for full details - It is for most mainland UK only and precludes some UK postcodes which are listed on this page.

5.10 We offer a one man delivery service as standard to keep delivery costs down, as result you may be asked to assist the drivers with larger items. Should this be a problem please contact us to discuss a two man delivery - please be aware that this will incur an additional cost.

5.11 We only guarantee delivery to the front door. Delivery to any other point is at the discretion of the driver and we do not accept any liability for damages done past this point.

5.12 In order to keep delivery costs competitive, we may deliver items on a pallet, especially to outlying areas. Please be aware that pallets are normally only delivered kerbside, so arrangements will need to be made to take the furniture indoors.

5.13 Whilst we make every effort to dispatch the products on time, we do not accept any liability for any failure to deliver on the stated date or at the stated time.

5.14 You will become the owner of the goods at the time of delivery, provided that we have received payment in full for the goods.

6 Returns, Refunds and Your Right to Cancel

6.1 Under the UK Distance Selling Act you have the statutory right to return any products you have purchased within Fourteen (14) working days after delivery for any reason. Products must be kept in the same condition as when purchased and in the same packaging in which they were delivered, see below for further details. N.B. For hygiene reasons mattresses are not covered by our returns policy.

6.2 In addition to your statutory rights we have extended our refund period to thirty (30) days after delivery. In order to return a product please contact us in writing or other durable medium (including email) within 30 days after delivery. You will then be entitled to a refund or exchange from us which will be paid within thirty (30) days of your notice of cancellation. Items must be kept in the condition in which they were purchased and in original packaging.  Items requiring assembly must not be assembled in any way or will not be accepted back. We reserve the right to refuse a refund if any item is deemed to be non re-sellable. Please do not fix packaging to pieces with tape, as this may damage the wood and finish.

Original delivery and collection charges are not refundable. We only ever chargeback our ‘cost’ for returns, or alternatively, customers can use their own designated carrier to return the item. Please contact us for details if wish to know how much this is in advance.

6.3 After the thirty (30) day return period has elapsed we shall be entitled to refuse returns on any items.

6.4 Subject to your statutory rights, products made or altered specifically for you, may not be returned nor will we provide any refund, unless they are defective or have been accidentally damaged by us in the course of delivery.

7 Defective Items

7.1 In the highly unlikely event that an item is defective, you must inform us by email within 30 days.

7.2 Claims for defective items must be supported by evidence in the form of digital photographs which you should email to us.

7.3 Hampshire Furniture will inspect the item to verify that the item is defective and if it is, the Customer’s account will be credited for the full value of that item, including carriage. If the item is deemed not to be defective, a full explanation will be provided by Hampshire Furniture. Hampshire Furniture has the final say on whether an item is defective or not. The value of the credit issued to the Customer is at Hampshire Furniture’s discretion and each case will be considered on its own merit.

7.4 Hampshire Furniture reserve their right to decide whether a damaged or defective item is replaced, repaired or refunded. Where the refund option is selected, it will be issued to the Customer’s PayPal account or credit card.

7.5 Please keep the products purchased in the same condition that they were received and retain the original packaging in the condition it was provided. We reserve the right to refuse return of items should the original packaging not be available to allow the safe return via our carriers. If we receive the goods back with us and they are damaged due to them not being repackaged sufficiently in their original packaging we will charge you for the reduction in value.

7.6 Should it be deemed impractical to offer a replacement, redelivery or re-selection of any damaged or faulty items we reserve the right to offer an allowance against a repair, or alternatively a refund for your purchase.

7.7 We will not be liable for any damage or loss resulting from repairs attempted by you or third parties.

7.8 We will not accept any returns (including damaged items) on self-assembly items which have been assembled - please fully check your item prior to assembly.

7.9 Hampshire Furniture will not be liable for any damage or loss caused by the 3rd party carriers within your property.

8 Cancellations

8.1 All orders must be cancelled in writing via email. Please send cancellations to support@HampshireFurniture.co.uk.

8.2 Orders can only be cancelled prior to despatch. Once the item has left the building the full delivery and return costs will be incurred.

8.3 Any funiture made to order, including the Rustic White Collection and therefore we do not offer a full refund. In the case where a customer would like to cancel an order that includes the Rustic White Collection we will refund the customer 80% of the order amount. The remaining 20% will not be refunded and will be passed on to the manufacturer as a re-stocking fee for the products.

9 Privacy Protection

Hampshire Furniture take information about you in order to respond to your queries and tailor our support to suit your needs. We do not provide this information to any third party companies or share it with affiliates. For more details please read our privacy policy page.

10 Entire Agreement

10.1 These terms and conditions together with our current website prices, delivery details, contact details and Privacy Policy set out the whole of our agreement relating to the supply of goods to you by us.

10.2 Nothing said by any member of Hampshire Furniture staff on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

11 Intellectual Property Rights

11.1 The content of this Website is © Hampshire Furniture (or its third party licensors).

11.2 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us (or our licensors).

11.3 You may not copy, reproduce, change, modify, license, transmit or sell any material or content contained herein (or supplied by Hampshire Furniture using other media) and you are permitted to use this material only as expressly authorised by us.

11.4 Hampshire Furniture reserves the right to withdraw any material supplied (including but not limited to: images, descriptions, technical drawings and price lists), at any time and without prior notice.

11.5 The furniture designs on the website are copyrighted and registered with the Intellectual Property Office, and any infringement will result in legal action.

12 Disclaimer

12.1 Hampshire Furniture is providing this Website on an “as is” basis and makes no representations or warranties of any kind, whether express or implied, in relation to this Website, or its contents and disclaims all such representations and warranties.

12.2 Hampshire Furniture makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information on this Website.

12.3 The information contained in this Website may contain technical inaccuracies or typographical errors. All liability of Hampshire Furniture howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

12.4 Neither Hampshire Furniture nor any of its directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of this Website and the purchase of products from this website (your statutory rights are not affected). This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

12.5. Hampshire Furniture accepts no liability for any information or content contained in external third party websites which link to or from this Website.

12.6 Notwithstanding the a foregoing, none of these exclusions and limitations are intended to limit any rights you may have as a consumer under local or other statutory rights which may not be excluded nor in any way to exclude or limit our liability to you for death or personal injury resulting from our negligence or that of employees and/or agents.

13 Applicable Law

13.1 We control and operate the web site from our offices within England. Accordingly the laws of England and Wales govern claims relating to, including the use of, this website and the materials contained therein.

13.2 If you choose to access our web site from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between ourselves and you the laws of England and Wales will apply at all times.
